Pdf Summary
The Washington State Department of Commerce presentation explains the Clean Buildings Performance Standard (CBPS), which aims to reduce building energy use, utility costs, air pollution, and greenhouse gas emissions.

The standard applies to Tier 1 buildings over 50,000 square feet (excluding parking) and Tier 2 buildings between 20,000 and 50,000 square feet, including multifamily buildings of at least 20,000 square feet. Owners must benchmark energy use and develop an Energy Management Plan and an Operations and Maintenance Program. Tier 1 buildings must also meet an energy performance target through one of several routes: meeting the target, satisfying investment criteria, reducing baseline energy use intensity by 15%, or electrifying space heating. Tier 2 buildings do not currently have to meet an energy target.

Compliance deadlines vary by building size: Tier 1 deadlines fall between June 2026 and June 2028, while Tier 2 buildings are due July 2027. Compliance is generally reported every five years. The presentation also describes new provisions under HB1543, including additional exemptions, extensions, and alternative compliance pathways.

Exemptions may apply in cases such as financial hardship, pending demolition, industrial or agricultural use, national security, or substantial vacancy. Eligible owners can request extensions of up to two years through the Clean Buildings Portal.

Noncompliance penalties can reach $1.50 per square foot plus $5,000 for Tier 1, and $0.30 per square foot for Tier 2, assessed each five-year cycle. Incentives include early-adopter funding: Tier 1 support may cover up to 50% of project costs, while Tier 2 incentives are generally $0.30 per square foot, with higher support for multifamily buildings. Other grants and technical assistance are also available.

Commerce provides guidance, training, portal support, and customer assistance. The presentation highlights school districts that have received compliance approvals and grant funding.
